Presumption of Paternity in Marriage

Under California paternity law, a child conceived during the marriage is conclusively presumed to be the child of the married parents. This presumption can be rebutted during the first two years after the birth of the child by evidence of DNA testing. The Court accepts DNA paternity testing as conclusive evidence of paternity.

Parties Who Have Never Been Married - Genetic Testing and Paternity Establishment

With the advent of DNA paternity testing, a court of law can now establish parentage in a relatively quick and easy procedure. The father can either submit to a paternity test, or a court order can be obtained to force the potential father into taking the test. Today’s DNA test results are accurate - nearly indisputable proof of parentage under California paternity law.
